The following terms and conditions of use (“Terms”) constitute a legal agreement between you and Alamy Limited ("Alamy", "we" or "our").
Please read these Terms carefully before using this website. Continuing to use this website indicates that you accept and agree to be bound by these Terms. If you do not accept these Terms, do not access or use this website.
1. Disclaimer
This website and its content are provided "as is" and Alamy excludes to the fullest extent permitted by applicable law any warranty, express or implied, including, without limitation, any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. This website is not warranted to be uninterrupted or without error.
Websites and companies listed on the Alamy website are not controlled by Alamy and Alamy is not responsible for any such websites or companies.
2. Ownership of the website and Content
This website is owned and operated by Alamy. The general design and content featured or displayed on this website, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations and software ("Content"), are owned by Alamy, its licensors and its content providers and are protected by, copyright, moral rights, trademark and other laws relating to intellectual property rights.
Except as explicitly permitted under this or another agreement with Alamy or one of its subsidiaries, no portion or element of this website or its Content may be copied or retransmitted via any means and this website, its Content and all related rights shall remain the exclusive property of Alamy, its licensors or its content providers unless otherwise expressly agreed.
"Alamy Images", "Alamy", and the Alamy logo, are trademarks of Alamy or its subsidiaries which may be registered in some countries.
3. Indemnification for breach
You agree to indemnify Alamy, its subsidiaries, affiliates and licensors against any losses, expenses, costs or damages howsoever incurred by any or all of them as a result of your breach of these Terms or your unauthorised use of the Content.
4. How you may use the Content on this website
The Content may only be used commercially once you have entered into a licence agreement and paid the relevant fee. Where Alamy permits you to use Previews, these may only be used for your internal layouts for sample purposes or for proofing presentations to end clients.
Alamy's copyright notice and Content identification reference which appear in the Content file must remain with your digital copy of the Content at all times. You will retain the copyright notice, the name of Alamy and the respective artist, the respective RM or RF Content ID and any other information or metadata that is embedded in the electronic file that comprises any image which you have downloaded from the website or otherwise received from Alamy. Failure to maintain the integrity of the copyright information will constitute a breach of these Terms.
Alamy does not grant you any licence to use the Content in any final materials distributed either internally or externally by yourself or your company, including any electronic or online system. Except for this limited, internal testing and sample use, Alamy grants you no other rights, and you may not distribute, sublicense or make available for use or distribution any comp images.
Alamy will only issue high resolution Content Files for "Preview" or layout purposes only after a separate agreement is entered into.
You may use our site only for lawful purposes. You may not use this website:
• In any way that breaches any applicable local, national or international law or regulation;
• In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
• To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You also agree:
• Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of these Terms; and
• Not to access without authority, interfere with, damage or disrupt any part of our website.
5. Prohibited content and complaints
Alamy will disable and/or remove Content and/or suspend or terminate the accounts of users who upload Content that is (i) illegal content as defined under the UK Online Safety Act 2023 (“OSA”) and EU Digital Services Act (“DSA”) (ii) material that otherwise violates applicable law or (iii) material that does not meet the standards set out in these Terms, our Quality Control Guidelines, the Contributor Contract, or section 11 (Forum) below (together, "Prohibited Content").
Illegal content under the OSA (as referred to above) includes, in particular, content that amounts to terrorism, child sexual exploitation and abuse, assisting suicide, threats to kill, public order offences, harassment, stalking and fear of provocation of violence, sale of drugs and psychoactive substances, firearms and other weapons, assisting illegal immigration, human trafficking, sexual exploitation, sexual images, and offences against animal welfare. Alamy will disable and/or remove any such Content to minimise the length of time for which this type of content is present on it and, when alerted to the presence of such Content, will swiftly take it down. When identified, Content that amounts to terrorism and/or CSEA, Alamy will disable and/or remove it within 24 hours.
Alamy has the right to remove or restrict any such material or to suspend or terminate the associated account if Alamy has reasonable grounds to believe that the Content uploaded amounts to Prohibited Content. Alamy will make any such determination in a diligent, objective, non-discriminatory, and proportionate manner, having regard to the fundamental rights of affected users. More detail on Alamy’s approach to permitted and prohibited material on the website can be found within our Quality Control Guidelines, the Contributor Contract, and section 11 (Forum) below.
Alamy does not review every image submitted by its contributors. Instead, Alamy uses human verification to review a cross section of Content uploaded to the platform, and periodically reviews on sale Content to ensure that uploads comply with the Quality Control Guidelines and the Contributor Contract, and do not contain Prohibited Content. Once Content is uploaded, Alamy carries out periodic checks to monitor if Prohibited Content is present on the service. In carrying out these checks, the content moderation team review the collection for content suspected of being Prohibited Content. If potentially Prohibited Content is identified, human moderators decide whether any such content should be removed or restricted. We are exploring utilisation of AI powered tools to assist in surfacing potentially Prohibited Content for human review and moderation.
Users with access to our Forum are required to adhere to the Forum Guidelines and terms detailed below under section 11 (Forum). Alamy uses human verification to review Forum posts on an ad hoc basis. If Content posted in the Forum is identified or reported to Alamy as containing Prohibited Content, we will review it and where appropriate disable access to or remove the relevant material in accordance with the process described in this clause 5.
You can report Content or complain to Alamy about Content via the Complaints Page. You can make a complaint or report in the following circumstances:
• If you consider Content to be Prohibited Content;
• If you think that Alamy is not dealing with Prohibited Content properly (this includes both Prohibited Content in general or specific Prohibited Content you have already submitted a complaint about) or if you think that Alamy is not giving regard to your freedom of expression and privacy;
• If you think that our content reporting processes are not sufficient, easy enough to use, or working properly; or
• If you want to complain about Content you have generated, uploaded or shared if that Content was disabled and/or removed by Alamy on the basis that it was Prohibited Content.
If the reporting tool is misused (for example, by repeated submission of manifestly unfounded complaints), Alamy may restrict or suspend your access to the reporting tool for a reasonable period. We will, however, provide you with a written warning prior to suspending your access. Alamy’s written warning shall set out the reasons for your suspension, as well as information on how the suspension decision may be appealed. In deciding whether you have misused the Complaints Page reporting tool, Alamy will consider (inter alia) the total number of manifestly unfounded notices you submitted, their relative proportion compared with your total submissions and, where identifiable, your intent.
Alongside handling user complaints via the Complaints Page, Alamy uses human review to verify a portion of Content at the point of upload and conducts periodic reviews of Content on sale to identify and remove Prohibited Content. These measures are designed to support effective enforcement of Alamy policies while respecting users’ fundamental rights.
If a user misuses the platform by repeatedly uploading Prohibited Content, Alamy may, after issuing a warning and following an assessment of the nature, severity, and frequency of the misuse, suspend or terminate the relevant account in accordance with our Content Strike Policy below. In such cases, the affected user will be notified without undue delay, provided with a clear statement of reasons, and informed of the available appeal and redress mechanisms, as described in this section 5 and section 13 below.
Content Strike Policy
Alamy has a policy of suspending or terminating the accounts of repeat infringers. When it is determined that a contributor has uploaded Prohibited Content this constitutes a “Content Strike”.
As a rule, and subject to the assessment described below, Alamy may suspend or terminate contributor accounts that receive three (3) Content Strikes within a twelve (12) month period. Multiple notices or complaints relating to substantially similar material that is received within a short period of time may, following review, be grouped together as a single Content Strike. In applying the Content Strike policy, Alamy takes into account all relevant facts and circumstances, including the number of instances of content that is reasonably believed to be illegal within a given period, the proportion of illegal content relative to the contributor’s overall activity, the severity and impact of the material, and the apparent intention of the contributor.
Alamy may remove a Content Strike where (among other things) (1) the underlying material is ultimately restored due to the submission of a counter-notification that is not answered by the copyright holder (2) the dispute leads to legal proceedings that result in a court finding that the contributor has not infringed the owner’s copyright or (3) the claimant withdraws the original Content notice/complaint.
Alamy may at its sole discretion terminate contributor accounts that receive fewer than three (3) Content Strikes in appropriate circumstances, such as where the user has a history of repeated violations or wilful disregard for Alamy’s Contributor Contract. Alamy also reserves its right to suspend or terminate a contributor account, with immediate effect, after a single Content Strike where the breach is particularly serious, poses a significant or immediate risk of harm to other users, or is otherwise incompatible with continued access to Alamy. Such violations include, without limitation, the posting, sharing or facilitation of Prohibited Content that amounts to any of the priority illegal content categories as defined under the OSA.
Before suspending or terminating an account under this Content Strike policy, Alamy will (except where the content is particularly serious in nature) issue a written warning to the affected contributor. The warning will set out the reasons for the possible suspension or termination and provide information on the possibility of redress against the decision.
Where Alamy restricts, suspends, or terminates a contributor account under this Content Strike policy, the affected contributor will be notified without undue delay, provided with a statement of reasons for the decision, and informed of the available redress mechanisms as set out in this section 5 and section 13 below.
In certain circumstances, this notice may be withheld, delayed or limited, including where providing a notice would:
• be unlawful or inconsistent with Alamy's legal obligations;
• risk further harm to other users or the public;
• interfere with investigations or law enforcement activities – in these circumstances, where appropriate, Alamy may provide notice as soon as it is legally possible to do so; and
• enable evasion or detection of moderation systems.
Where Alamy identifies Content that it is legally required to report, we will report such Content and any relevant associated information to the appropriate national law enforcement or regulatory authorities, without providing notice to the user concerned.
You can make a complaint to Alamy by contacting legal@alamy.com in the following circumstances:
• If we have removed or restricted your Content, or suspended or terminated any associated accounts and you consider this has been done unfairly;
• If you have concerns that, in removing or restricting your Content or suspending and terminating your account, Alamy has not sufficiently considered the protection of your fundamental rights, including your freedom of expression or privacy; and/or
• If we have not removed or restricted Content, or suspended or terminated any associated accounts, that you complained about and you consider this decision has been taken unfairly and against these Terms.
6. Copyright infringement
Prohibited Content includes material that infringes copyright or otherwise violates the intellectual property rights of Alamy or any third party. In accordance with the Digital Millennium Copyright Act ("DMCA"), DSA and other applicable law, Alamy has adopted a policy of terminating, in appropriate circumstances based on an assessment of all relevant facts and circumstances, , account holders who infringe the intellectual property rights of Alamy or any third party.
Notification
If you believe that any material on the Alamy website infringes upon any copyright that you own or control, you may file a notification of such infringement (“DMCA Notice”) by reporting via our legal Complaints Page or with our designated agent as set forth below:

Notification must include the following information:
• Your name, address, telephone number, and email address;
• A description of the copyrighted work that you claim has been infringed;
• The exact URL, Alamy Image ID or a description of where the material is located;
• A statement by you that you have a good faith belief that the content you claim infringes your copyright interest was copied without your authorization or that of the copyright owner or his/her/its agent; and
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are either the copyright owner or authorized to act on the copyright owner's behalf and that you do not wish the content to be displayed in the future on the Site. If you are authorized to act on behalf of the copyright owner, you must provide an electronic or physical signature.
Before you file your DMCA Notice, please carefully consider whether or not the use of the copyrighted material at issue is protected by the Fair Use doctrine. If you knowingly file a DMCA Notice when there is no infringing use, you could be liable for costs and lawyers’ fees. If you are unsure whether someone’s use of your copyrighted material amounts to infringement, please contact a lawyer.

Counter Notification
If you are an Alamy contributor who wishes to challenge the removal of materials caused by a DMCA Notice, you must file a counter-notification containing the following:
• Your name, address, and telephone number and email address;
A description of the material that was removed and the Alamy Image ID;
• A statement made under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address provided by you is located, or if your address is outside of the United States, you consent to any judicial district in which Alamy may be found, and that you will accept service of process from the person who filed the original DMCA Notice or an agent of that person; and
• Your electronic or physical signature.

Alamy will forward any complete counter-notification to the person who filed the original DMCA Notice. The copyright owner(s) may choose to initiate legal proceedings against you for copyright infringement. If we do not receive notice that such legal proceedings have been filed within ten (10) business days after we provide notice of your counter-notification, we may restore the challenged materials. Until that time, your materials will remain removed.
Before you file your DMCA counter-notice, please carefully consider whether or not your use of the material at issue is infringing. If you knowingly file a DMCA counter-notice when your use is infringing, you could be liable for costs and lawyers’ fees. If you are unsure whether your use of the content at issue amounts to infringement, please contact an attorney. You might also want to consult publicly available reference materials such as those found at the U.S. Copyright Office website.
7. Marketing and Promotion
If you authorise us to send you promotional materials, we may do so using either the email or the mailing addresses you provided on the registration or billing information screens. From time to time where we are entitled to do so we may notify you of special promotions, new products or services, or other information that may interest you.
Should you not wish to receive this type of information, you will be able to express this desire by clicking on the appropriate 'unsubscribe' or 'change your preferences' button or checkbox available on our communications to you, or by modifying your profile at any time. We will not send you information if you expressly inform us you do not wish to receive such materials.

8. Data protection
Please note we may collect personal information about you. Our Privacy Notice sets out the basis on which we collect your personal information, what information we collect and how, and how we process your data.
9. Cookies
When you visit the Alamy website, we place a text file called a "cookie" in the browser directory of your computer's hard drive. A cookie is a small piece of information that a website can store on your web browser and later retrieve. The cookie cannot be read by any website other than the one that set up the cookie. Please see our Cookie Policy.
Cookies enable this website to recognise the information you have consented to give to this website, such as the lightboxes you have created, and help us determine what portions of this website are most appropriate for your professional needs. As a result, cookies will allow you to retrieve previous image search results, access lightboxes with ease, and view your previous invoices.
We do not use cookies to examine your surfing behaviour before or after leaving the Alamy website.
10. Liability
Except as specifically stated in these Terms, the Privacy Notice, or elsewhere on this website, or as otherwise required by applicable law, neither Alamy nor its directors, employees, licensors, content providers, affiliates or other representatives will be liable for damages of any kind (including, without limitation, lost profits, direct, indirect, compensatory, consequential, exemplary, special, incidental, or punitive damages) arising out of your use of, your inability to use, or the performance of this website or the content whether or not we have been advised of the possibility of such damages.
There may be links to other websites from the Alamy website; however, these other websites are not controlled by Alamy and we are not responsible for any content contained on any such website or any loss suffered by you in relation to your use of such websites. You waive any and all claims against Alamy regarding the inclusion of links to outside websites or your use of those websites.
Alamy uses reasonable efforts to ensure the accuracy, correctness and reliability of the Content, but we make no representations or warranties as to the Content's accuracy, correctness or reliability. You should note that in certain countries captions, keywording and other information associated with an Image(s)/Video(s) may have been translated from the original language into another language using an automated machine translation process that Alamy has had no input into or control over.
Accordingly, Alamy disclaims any liability for inaccurate, misleading, defamatory, insulting, offensive, infringing or unlawful content created as a result of or arising out of such translation process. If you have a complaint about inaccurate, misleading, defamatory, insulting, offensive, infringing or unlawful content please send a specific and detailed notice via our legal Complaints Page. 11. Forum
The Alamy site contains a contributor forum (“Forum”)
When you have registered as a Forum user you acknowledge and agree that:
Forum users are solely responsible for their use of the Forum and each Forum user is solely responsible for any content posted therein.
You will adhere to our Forum Guidelines and will keep your comments relevant to the discussion topic and will not submit comments which:
• include prohibited Content
• spam or flood the Forum with excessive or similar posts.
• are excessively or repeatedly off-topic with respect to the Forum’s subjects.
• advertise or promote your or a third party’s products or services.
You will not use the Forum for the purposes of uploading or posting any information or content that:
• is in breach of any applicable law;
• may be deemed to constitute incitement to racial hatred, child sexual abuse material, slander, insult, instigation of rebellion, discrimination against any group, an unlawful description of violence, or a violation of any right of any third party;
• may be conceived as harassing, threatening, abusive, insulting, racist, offensive, vulgar inappropriate and/or indecent; or
• may be deemed defamatory with respect to Alamy, its customers, or another Forum user or in a way that may bring Alamy’s marks and/or name into disrepute.
Alamy reserves the right in its sole discretion to remove any content and/or posts without prior notice and/or suspend or terminate your Forum membership following the processes described in section 5 above.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales whose courts are the courts of exclusive jurisdiction.
These Terms will not be governed by the United Nations convention on contracts for the international sale of goods or any other similar convention or laws, the application of which are expressly excluded.
13. Termination, restriction and appeals
As set out under section 5 above, Alamy will disable and/or remove Prohibited Content and/or suspend or terminate the accounts of users who upload such material.
If you believe your Content was removed in error and does not qualify as Prohibited Content, you may submit an appeal by email to legal@alamy.com. You may wish to make an appeal in the following circumstances:
• If we have removed or restricted your Content, or suspended or terminated any associated accounts and you consider this has been done unfairly; and/or
• If you have concerns that, in removing or restricting your Content or suspending and terminating your account, Alamy has not sufficiently considered the protection of your fundamental rights, including your freedom of expression or privacy.
You may also submit an appeal to legal@alamy.com if we have not removed or restricted Content, or suspended or terminated any associated accounts, that you complained about and you consider this decision has been taken unfairly and against these Terms.
Appeals must be made within six (6) months after the notification of removal was issued and contain the following information:
• Your name, address, telephone number, and email address;
• A description of the material that was removed;
• The exact URL, Alamy Image ID, and a description of where the reported material is located;
• A description as to why you consider the material not to be Prohibited Content; and
• A statement that the information contained in the appeal is accurate and complete.
Alamy shall identify complaints that are appeals promptly. It shall review any such appeals in a timely, fair, non-discriminatory, and objective manner, including considering the fundamental rights of all affected parties. The final decision on an appeal will be taken by trained human staff and will not be based solely on automated processes. Following the conclusion of Alamy’s review, the appellant will be informed of the outcome without undue delay.
If you appealed the removal or restriction of your Content, or the suspension or termination of any associated account, and your appeal is successful, Alamy will reverse the initial decision and reinstate the Content and/or account to the extent possible (unless otherwise prevented by law). If Alamy decides to uphold its initial decision, the Content and/or account will remain removed or restricted as applicable.
If applicable, Alamy will take appropriate steps to ensure that the use of automated technology does not result in the same Content being taken down again.
If you appealed Alamy's failure to remove or restrict someone else's Content, or suspend and terminate someone else's accounts, and your appeal is successful, Alamy will remove or restrict the appealed Content and/or suspend and terminate any associated accounts. If Alamy decides to uphold its initial decision, the Content and/or account will remain active or available, as applicable.
If you appealed Alamy's failure to remove or restrict someone else's Content, or suspend and terminate someone else's accounts, and your appeal is successful, Alamy will remove or restrict the appealed Content and/or suspend and terminate any associated accounts. If Alamy decides to uphold its initial decision, the Content and/or account will remain active or available, as applicable.
Any manifest abuse of the appeals process (including the repeated submission of clearly unfounded appeals) may result in the indefinite suspension of your ability to use the appeals process. Before implementing any such suspension, Alamy will issue a warning that (i) sets out the reasons for suspension and (ii) provides information on how any suspension decision may be appealed.

Where you have submitted a complaint or appeal under clause 5 or 13 of these Terms and the matter has not been resolved through Alamy’s internal processes, you may choose to refer the dispute to an EU-certified out-of-court dispute settlement body. This applies to complaints or appeals made under the DSA. If the issue at hand has already been resolved, Alamy can refuse to engage with the dispute settlement body. In accordance with section 72(1) of the OSA you have the right to bring a claim against Alamy for breach of contract where (i) your Content was taken down or restricted in breach of these Terms; or (ii) where your access to the website is restricted in breach of these Terms or (iii) where your account is suspended or terminated in breach of these Terms.
14. General
Recommender Systems
When you input a search query into Alamy, Alamy uses an automated tool to provide the most relevant search results to you – this system uses “relevance logic”, which is applied uniformly to your search input and content metadata using the following criteria:
• How well Content matches the terms use in the search query;
• Whether you have selected a specific Content category when making your search query; and
• Whether you have selected a search result sort order.
You are able to influence the search results that are available to you by amending the sort order and filters described below. The search results sort order you can include are:
• Relevant
• Most recently uploaded
• Newest date taken
• Oldest date taken
Filters can be applied to refine your search results and include:
• Licence type: All licence types, Rights Managed, Royalty Free
• Releases: Model released, Property released
• Date taken: Last week, Last month, Last 3 months, Last 6 months, Last 12 months, Last 2 years, or a custom date range
• Image orientation: Landscape, Portrait, Panoramic, Square
• Style: Colour (including selection by specific colour), Black and white, Cut-outs
• Minimum file size: 15MB, 24MB, 48MB, 70MB
• People: Number of people (No people, 1 person, 2 people, 3 people, 4 people, or Groups of people), Age, Ethnicity, and Viewpoint
• Location: Including UK, USA, Europe, Australia
• Agency collections: Filtering by specific agency collections
• Search builder: Refining searches using exact phrases, inclusion or exclusion of specific words
• Contributor search: Searching by a specific contributor name
These tools allow you to refine and control the search results presented to you.
From time to time may update these Terms, our Privacy Notice, our Cookie Policy, and contractual license terms featured on the website. We will publish the updates on the relevant website page and indicate the date of the latest update.
Any significant changes to these Terms will be notified to users via email, in-service notice, or a prominent notice on our website. “Significant changes ” are those that materially affect your rights and obligations as users or materially affect how you can use the service.
No action of Alamy, other than an express written waiver or amendment, may be construed as a waiver or amendment of any of these terms, the Cookie Policy or Privacy Notice. Should any clause of these Terms or Privacy Notice be found unenforceable, wherever possible this will not affect any other clause, and each will remain in full force and effect.

4. How you may use the Content on this website
The Content may only be used commercially once you have entered into a licence agreement and paid the relevant fee. Where Alamy permits you to use Previews, these may only be used for your internal layouts for sample purposes or for proofing presentations to end clients.
Alamy's copyright notice and image identification reference which appear in the image file must remain with your digital copy of the image at all times. You will retain the copyright notice, the name of Alamy and the respective artist, the respective RM or RF image ID and any other information or metadata that is embedded in the electronic file that comprises any image which you have downloaded from the website or otherwise received from Alamy. Failure to maintain the integrity of the copyright information will constitute a breach of this agreement.
Alamy does not grant you any licence to use these images in any final materials distributed either internally or externally by yourself or your company, including any electronic or online system. Except for this limited, internal testing and sample use, Alamy grants you no other rights, and you may not distribute, sublicense or make available for use or distribution any comp images.
Alamy will only issue high resolution images for "Preview" or layout purposes only after a separate agreement is entered into.
You may use our site only for lawful purposes. You may not use this website:
• In any way that breaches any applicable local, national or international law or regulation;
• In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
• To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

5. Illegal Content
Alamy will disable and/or remove content and/or suspend or terminate the accounts of users who upload illegal content to our platform or upload any content with the intention to cause or incite harm as defined by the Online Safety Act 2023.

13. Governing law and jurisdiction
This agreement is governed by the laws of England and Wales whose courts are the courts of exclusive jurisdiction.
This agreement will not be governed by the United Nations convention on contracts for the international sale of goods or any other similar convention or laws, the application of which are expressly excluded.
14. Termination and restriction of use of the website
Alamy may block, restrict, suspend or terminate your account and / or access to all or part of the website and/or its Content without prior notice and at Alamy’s sole discretion.
In accordance with Section 72(1) of the Online Safety Act 2023 you have the right to bring a claim against Alamy for breach of contract where your access to the website is restricted in breach of these Terms ; or where your account is suspended or terminated in breach of these Terms.
